RELATIONSHIP WITH CLINICS AND PAYMENTS

Seoul Glow is not a medical provider and does not perform or supervise any treatments. All medical services are provided by independent, third-party clinics. Seoul Glow does not guarantee the availability, safety, results, or quality of any treatment.

Seoul Glow is not the merchant of record for any services listed. All payments are made directly to the clinic following completion of treatment. Any refunds, cancellations, or disputes must be resolved directly with the clinic, in accordance with its individual policies.

By using our Website and services, you acknowledge and agree that Seoul Glow is not responsible for the actions or omissions of any third-party providers.

PHOTO AND REVIEW SUBMISSIONS

By submitting any photos, reviews, or feedback to Seoul Glow, including but not limited to before-and-after images or written testimonials, you grant Seoul Glow a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and publicly display the content for marketing, promotional, or educational purposes. You represent that you have the necessary rights and consents to grant this license and acknowledge that your submissions may be publicly viewable.

If you do not wish to have your photo or review published, you must notify us in writing at linda@seoulglowskin.com.

 

BIOMETRIC AND IMAGE DATA

If you submit images for analysis, including for AI-based skin assessments, you consent to our use and processing of these images solely to provide personalized treatment recommendations. We do not sell biometric information. Our use complies with applicable U.S. state privacy laws, including any requirements under the Illinois Biometric Information Privacy Act (BIPA), California Consumer Privacy Act (CCPA), and others as required.

ASSUMPTION OF RISK; COVENANT NOT TO SUE

You understand and acknowledge that medical and aesthetic treatments, especially those performed abroad, carry inherent risks. These risks may include, but are not limited t,o adverse reactions to treatments, medical complications, miscommunication due to language barriers, cultural misunderstandings, variations in medical standards or regulatory oversight, unexpected results, infection, scarring, injury, permanent changes in appearance, or, in rare cases, death.

You further acknowledge that Seoul Glow is not a medical provider, does not provide medical advice, and does not itself offer or perform any medical procedures. Seoul Glow acts solely as a concierge platform facilitating coordination and communication between you and third-party clinics and providers. Seoul Glow does not endorse or guarantee the qualifications, safety standards, outcomes, or effectiveness of any treatment or service offered by these third parties. You are solely responsible for conducting your own due diligence and making informed decisions.

By using the Website, you voluntarily assume full responsibility for all risks, known or unknown, associated with medical travel and elective procedures. You knowingly and irrevocably release, waive, and discharge Seoul Glow LLC, its owners, officers, employees, agents, contractors, successors, and affiliates from any and all liability, claims, demands, or causes of action—whether arising in contract, tort, law, equity, or otherwise—related to or arising out of your use of the Website, your interactions with clinics, and any services you obtain through the platform.

You also agree not to bring any lawsuit or legal proceeding against Seoul Glow for any injury, loss, damage, or dissatisfaction resulting from treatment obtained through a third-party clinic. This covenant not to sue is binding on you, your heirs, assigns, and legal representatives, and applies to any claim arising out of negligence, misrepresentation, malpractice, or breach by a third party.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Seoul Glow LLC, its affiliates, officers, directors, employees, agents, contractors, licensors, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • your violation of these Terms of Use;

  • your use of or access to the Website or any content, services, or products offered through it;

  • any User Contributions you submit, post, transmit, or otherwise make available through the Website;

  • your use of third-party services obtained via Seoul Glow; or

  • your violation of any law, regulation, or the rights of a third party.

This indemnity obligation will survive the termination or expiration of your use of the Website and your relationship with Seoul Glow.

FORCE MAJEURE
Seoul Glow shall not be held liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, government actions, pandemics, travel bans, labor shortages, telecommunications or internet failures, cyberattacks, or natural disasters. Such events do not constitute a breach of these Terms of Use.

GOVERNING LAW AND JURISDICTION
All matters arising out of or relating to these Terms of Use, the Website, or any services provided by Seoul Glow shall be governed by and construed following the internal laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Website shall be instituted exclusively in the state or federal courts located in Los Angeles County, California. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

ARBITRATION
At Seoul Glow’s sole discretion, any disputes or claims arising out of or in connection with these Terms of Use or your use of the Website—including, without limitation, any dispute regarding the breach, termination, enforcement, interpretation, or validity of these Terms—may be submitted to final and binding arbitration in Los Angeles County, California. Arbitration shall be conducted by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules and, where appropriate, its Consumer Arbitration Rules.

If arbitration is elected, both you and Seoul Glow waive the right to a trial by jury and to participate in a class action or class-wide arbitration. Each party shall bear its own legal fees and costs associated with the arbitration, unless otherwise provided by applicable law.

LIMITATION ON TIME TO FILE CLAIMS
Any cause of action or claim you may have arising out of or relating to these Terms of Use, the Website, or any services accessed through the Website must be commenced within one (1) year after the claim or cause of action accrues. Otherwise, such claim or cause of action is permanently barred.

This limitation applies regardless of when you became or should have become aware of the claim and survives the termination of your use of the Website.

WAIVER AND SEVERABILITY
No waiver of any provision of these Terms of Use by Seoul Glow shall be deemed a further or continuing waiver of such provision or any other provision, and any failure of Seoul Glow to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT
These Terms of Use, along with our Privacy Policy and any other legal notices published by Seoul Glow, constitute the entire agreement between you and Seoul Glow concerning your use of the Website. They supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website and services provided through it.

If you are a clinic partner, affiliate, or service provider with a separate written agreement with Seoul Glow, that agreement shall remain in full force and effect. In the event of a conflict between the separate written agreement and these Terms, Seoul Glow reserves the right to determine which shall govern.
